Garnishing My Wages

Your not gonna believe this one!!!! I bought a car over 7 years ago from JD Byrider. I was late on one payment on my $10,500.00 Bonneville that was about 10 years old, they came to my home and put a "club" on my steering wheel and advised they would remove when I brought my account up to current status. I told them in no uncertain terms would I pay them for a car I could not drive. I refused to pay and they repossessed the car. Seven years later my paycheck is being garnished @ $300.00 Bi-weekly for a car they repoed! Is this legal? I live in Indiana.

They do repo for one payment being 1 day late. They also won't accept your payment if you try to pay 5 days late. This is a fact. It just happened to me! I was ok with paying to much for a car. Because I had done it before. At least it had a warranty. Get a little behind, yes once, and they will take your car. I promise.

What do you mean you won't pay for a car you could not drive?

You would have been able to drive it as soon as you made your payment. A payment you owed!!

This is the kind of irresponsible attitude that makes my stomach turn. Its also the same mindset that caused you to become a Byrider customer in the first place. Not taking responsibility for your debts.

I would be curious to see how many repos, bankruptcies, bad credit cards, etc, you have on your credit report.

And isn't it amazing how these things happen after only "one" late payment?? Come on! Get real. I'm sure you probably made many late payments and they were finally tired of jacking with you.

Thats usually how it works.

Yes, every thing they did was legal. You signed a binding contract and now you have to follow through.

check the laws in your state

All states have a statue of limitations on how long anyone can collect a debt. Your state is 20 years, and a judgment can be renewed every 20 till you pay. Also they can tact on 10% interest on the amount owed. I wish I could tell you something better. The best thing I can tell you is to change jobs, and never run your credit, keep a unlisted pvt phone #, Move to a new place, and never give out your info. We all leave foot prints so you have to be careful. But If I were you I would just file for bankruptcy,to get out from under it. good luck

Completely Legal

You signed a legally binding contract for $10,500 and you owe it until its paid off in full. CNAC lends money, they don't lend vehicles. You should've just worked it out and made payment arrangements with them. You can't expect to keep using something you're not paying for, right? Doesn't your phone company shut off your phone if your bill is late? Same theory except you're talking about thousands of dollars and potentially jeopardized collateral.

YOU MEAN BARELY LEGAL

Selling defective merchandise is illegal in every state in the nation. The States Attorney General's Office in the State of Kentucky , found that the product and services rendered by your company was "Substandard to a point of criminal intent " or you would not have lost the lawsuit filed by the STATE! It is just a matter of time until someone can convince the proper authorities to investigate your methods. The sweet thing is that everyone that is involved and is complicit in these credit "arrangements" can be charged with a crime as well. So Mr. it's on video tape, the tape also shows that your methods are repeated time and again and is in fact a part of the business model. The class action penalty also suggests that the monies that you were made to pay to those that were smart enough to speak out, also means that those were ill gotten gains. One thing is for sure, you may be a smart criminal, but white collar crime units love you dumb asses that think you are invincible. I hope that your state investigates you next. All good things come to and end, but fleecing the poorest and the downtrodden is the lowest thing on earth. And I hope that you get what you truly deserve. maybe a cellmate named "BUBBA" that you sold a car to. :P

12scewwit hits it on the head, all of the managers who promote JD's philosophies and practices should pay attention! Pull your head out of your asses long enough to understand that if you knowingly are cheating the public by using the corporate business model, then as officers of that company, you can also be found liable! I hope that as the word spreads and each state finds out what Kentucky has done, then the appropriate authorities will also take action. This company needs to be out of buisness before they harm too many other innocents. JD takes advantage of those who can afford it the least, be warned Jimmy, Randy and Brent, the public will not stand for this crap and your day is coming! We will all dance on your corporate headstone and have a party!

This is a response to the people known as 12screwwit & Uallgotscrewed.

This is your website and you can run it as you see fit, but to paint a rosy picture that all of these people on here are somehow "innocent victims" is just not being realistic.

I agree with the both of you when you say that sometimes bad things happen to good people.

But I wish some of you on here crying, could sit on the other side of the desk for just one day.

Yes, one bankruptcy, one reposession, thats something bad happening to a good person.

2 or 3 repos. 2 or 3 bankrupties, countless unpaid credit cards and utility bills...

Well, thats just someone who doesn't give a damn about paying their bills or screwing up their credit.

And the folks at Byrider have to deal with those types of customers every day. That is the bulk of their customer base.

I saw those types of credit reports waaay too many times. People who don't pay a soul.

Then wanna whine and cry when they have to pay 11 grand for a 4 grand vehicle. Or cry when they get repoed for the umpteenth time.

At what point does it stop being about a "crooked" car dealership and start being about taking responsibility for ones own situation??

I'm not saying that there aren't ligitimate beefs on here. I'm sure there is.

But this is also becoming a forum for deadbeats to rant and rave and lie and place the blame on others, rather than looking in the mirror and start making the changes there.
