JD Byrider and Insurance?

Recently my son bought a truck from JD Byrider in Indianapolis. It was his first purchase of a vehicle from a lot. The next day, the bed liner blew out of the truck and damaged a Lexus. The cost of the damage was over 4500.00. I then learned that JD Byrider did not make sure there was insurance on the truck. I know my son bears a responsibility to get insurance, but JD Byrider in no way even mentioned to my son that insurance has to be on the vehicle. All it would have taken was a call from the lot to my son's insurance company and his policy would ave been transferred from the vehicle he traded in. I knew right then my son was going to get screwed by CNAC/JD Byrider. My son was also ticketed for not having a safe load on his truck and for not having insurance. His truck was towed. JD Byrider did pay to have my son's truck to be released from the impound lot and replaced the bed liner in accordance to the warranty on the truck. Because my son did not have insurance on the truck, the people who owned the Lexus filed a law suit against my son for the cost of the repairs on their car. I contacted JD Byrider, asking them to take responsibility for all damages, including paying the fines for my son. My argument was, JD Byrider was negligent for not making sure their investment was insured, and if it had not been for the bed liner blowing off the truck, we would not be having this discussion. JD Byrider agreed...to a point. They said they would be responsible for the damages to the Lexus, but not for my son's tickets, fines, and the fees required to get his license back because his license was suspended for not having insurance on his truck. JD Byrider was glad to take care of a non-customer because they had lawyers to back them up, but not their own customer. I am still in battle with these guys because I truly think JD Byrider should be fully responsible. You know what's really bad about these guys? They claim to sell nice vehicles, but all I have ever seen were very high mileage vehicles no real car lot wants, and they sell them for twice for what they are worth, and charge the very highest interest rates that are allowed by law. JD Byrider treats their customers like crap, while at the same time they boast on how they are going to help their customers credit rating. I am 100% in favor of getting rid of these guys. You have to wonder why a company has to have all these legal mumbo jumbo documents for all of their customers to sign before a car leaves a lot. It's a joke!!! One of the simplest things they could have done in my son's case was to make a simple phone call to my son's insurance company. JD Byrider/CNAC failed miserably.

Okay, I’m confused. J.D. Byrider/CNAC, paid for the damage on the Lexus right? That’s what the insurance would have paid for, so that’s a wash. As far as the tickets go, unless your son has been living in a cave for the last several years with no human contact are you expecting us to believe he didn’t know he was supposed to have car insurance? The company does not hide anything from the buyers; everything from the total cost of the vehicle and what the total amount paid is going to be, there is a contract documenting the mileage on the car or truck. Why is it that people always seem to have “problem with their paycheck” right when a major bill is to be paid? Why don’t you loan him the money and he can pay you back when this “problem” gets fixed? Your son is an adult right? Why are you still handling all this for him? I don’t see what your gripe is here.

Are You Kidding?

It is absurd to think that JD Byrider should be responsible for tickets, fines, court costs and whatever else. When you take a driver's ed class they do not go over every driving law on the books. It is the responsibility of the driver to know the laws and follow them. If your son is too irresponsible to know the laws, then he is definately too irresponsible to own a vehicle and to have a driver's license. I agree that the incident wouldn't have happened had the vehice been in proper condition, but it is also the responsibility of the vehicle operator to ensure that any vehicle they take onto a public street is safe to operate. It was nice of them to take care of the damage to the other vehicle, as they probably should have. To say that they should pay the fines incurred to your son not being insured is just ridiculous. Also, it may be time to cut the cord. If you are doing al of the battling for your son and he cannot defend himself, he is not grown up enough to be buying anything of that significance. Let it go, be thankful your son is not injured or in prison and realize that JD Byrider is doing all they should do.

I wonder, how many people have given up on their loans, based solely on the attitude of the people that work there?

Look, I used to work with 'accounts receivable', albeit in a different setting. Dealing with businesses mostly. Sometimes, these businesses, would be 30 days late! Avg. transaction was around $500. Company probably stood to GAIN about 20% on each.

Would I have called the customer, on the first day, and make all sorts of crazy threats, and, act like a jackass?

No, because that's a great way to lose a customer! And, that's a great way, for word of mouth, to spread about your overly-aggressive business practices!

I can truly appreciate, wanting the payments to come in on time. I always did my best, to do so (JDB didn't accept credit cards, when I had mine, so, for us, that meant a 45min drive every 2 weeks, yet, we still made it...). However, One of the things, that pushed me towards giving my clunker back, was that I have never heard such language, from a company that I am giving LITERALLY THOUSANDS OF DOLLARS A YEAR TO!

Now, legally, CAN they act like this on day 1?

SURE!

However, just because you CAN do something, does not make it right, nor appropriate.

All it would have taken for JD Byrider to do, is say,"here Mr. Customer, while I'm filling out your papers to make it legal for us to cause you pain for the term of our high interest loan, for a car that anyone else can buy for 3,000.00 less than you can, only because you don't have a credit history yet, you Mr. Customer can call your insurance company and transfer the insurance from the car you traded in for what its half worth," JD Byrider is a place for good people to have a last desperate attempt to buy a vehicle so that the people can go to their jobs and raise their families. JD Byrider takes gross advantage of people...good people. They have no grace period...not even a day, if someone can't make a payment on time. I know it's important to make timely payment, but geeezzzz...do they have to threaten to repo your car for a 1 day late payment? I was in the hospital with my child and could not make a payment on time. I had the money (cash) and called them telling them of my situation and that I would make my payment the very next day. They treated me like a liar. They insisted either I get to CNAC by the end of the day, or they would report my car as stolen. That was 5 years ago and after talking to management, they assured me that this was an isolated incident. I trusted them with that same child for him to purchase a car. It was a last desperate attempt for my son to have a reliable car to get back and forth to work. He has made every payment either early, or on time. Last weekend, his job had a problem with the debit card system and my son could not get his money out of his account. I said..call CNAC and keep them informed. CNAC treated him like he was a low life and threatened to repo his truck. That's when I realized...JD Byrider's treatment of me 5 years ago was the norm for them.

a heads up

Today is Friday March 2, 2007, and my son's truck payment is due. Get this, my son's employer is having a problem with their electronic funds system. Long story short, he receives no paycheck, his money goes into an account and he accesses his money through a debit card. Well, this account is not working, my son called his employer, they say there is a problem with their system, and my son should be able to access his money when they get this problem fixed. My son called CNAC about this problem and immediately, they threatened to repo his truck. They say they "have no grace period." I plan to keep documenting EVERYTHING inside this forum. I may build my own web site that's devoted to JD Byrider's bad business practices. JD Byrider/CNAC has to go!
