ANOTHER HORROR STORY

MY HUSBAND AND I WAS BUYING A CHEVY CAMERO FROM JD.BYRIDER/CNAC. IN DECEMBER RIGHT BEFORE CHRISTMAS WE MISSED A PAYMENT. I WROTE TO CNAC AND EXPLAINED OUR SITUATION AND TOLD THEM THAT WE WOULD MAKE TWO PAYMENTS ON DEC 29TH. WE NEVER HEARD ANYTING SO WE ASSUMMED THAT IT WAS ALRIGHT AND THEM ON DEC 26TH WE RECIEVED A LETTER FROM CNAC SAYING THAT WE HAD TILL THE 29TH NO EXCEPTIONS.. SO THAT WAS ALRIGHT WITH US HOWEVER ON DEC 27TH. I WENT OUTSIDE TO HAVE A SMOKE ONLY TO NOTICE THAT THE CAMERO WAS GONE. ASSUMING THAT IT WAS STOLEN SINCE THE CAR WAS LOCKED AND THE KEYS WERE IN THE HOUSE. WE CALLED OUR LOCAL POLICE DEPT. ONLY TO BE TOLD THAT JD BYRIDER/CNAC NOTIFIED THEM THAT THEY WERE REPOING THE VEHICLE. NO ONE KNOCKED ON THE DOOR LET US GET OUR THING'S OUT OF THE CAR OR EVEN TAKE OUR PLATES OFF. WE NEVER HEARD A SOUND.. NOW THE CAR IS SETTING ON THEIR LOT AND FOR US TO HAVE THE CAR BACK THEY WANT US TO PAY THE TWO PAYMENTS PLUS ALL THE PAYMENTS THAT ARE NOW PAST DUE SINCE THE CAR HAS BEEN ON THEIR LOT ALONG WITH A $150.OO REPO FEE. THEY ARE ALSOO THREATING TO GARNISH MY HUSBAND'S WAGES FOR WHAT THEY DON'T GET FOR THE CAR AT AN AUCTION. HOWEVER THE CAR IS STILL SETTING ON THEIR LOT AND HAS BEEN SINCE DEC 29TH. ANY LEGAL ADVICE WOULD BE WONDERFUL....

Get at them legally

By filling out complaint forms at the State Attorney Generals Office of your state, you will bring unwanted attention to the business practices of this "sham" company. JD Byrider/CNAC misrepresent themselves as an entity that is out to assist the public with "rebuilding thier credit" when in fact what they do has harmed more people than they have helped for an unquetioned profit. If you can sell the same car 4 or 5 times at just the price of the downpayment, think of how much profit they have gained and how few vehicles they have actually "sold". These criminals think that ebcause you and I have faced some hard luck in our lives, that gives them carte blance to take from us at will. Don't sit still for it. File a complaint with the better business bureau, the comsumer protection agency and with your states State Attorney General's Office, encourage others that have gone through this charade to do likewise and then continue to follow up on the investigations that result. You could vvery well be refunded your money and recieve punitive damages if and when they are fined/shut down for thier business practices. The state of Kentucky has already begun an investigation into thier business dealings and JD Byrider/CNAC are scrambling top "please" those customers that got slighted by thier dealings. Full refunds and apologies have been given and in some cases, damages were awarded. It takes time and patience, but you can get it back and clear them from your credit report once and for all. Don't let thier "strongarm" tactics fool you, ignore them and proceed with seeking justice. Good Luck.

...aren't paying much attention to what she said. I agree that she should have managed her finances better knowing that Christmas was coming, IF she did in fact spend her car payment on presents. We have no way of knowing that she did, but that's beside the point. She said they accepted her request to make two payments by December 29th. But they then came and repossessed her vehicle TWO DAYS before that. That's hardly fair, and I'd have been pissed too. If they didn't want to give her until the 29th, they shouldn't have agreed to it.

Well DJRF8, they are not going to knock on the door and risk a confrontation. Let me guess, you used your car payment money to buy Christmas presents right? Christmas comes on the same day every year, you had plenty of time to plan financially to buy presents and make your car payment. Yes a wage garnishment is one way for CNAC to collect the deficiency balance on the loan, so be prepared. As far as the $150.00 repo fee, you got off cheap. Like SKYNET said, you have NO legal recourse.
